1. Scope of application / General
These General Terms and Conditions (hereinafter referred to as GTC) apply to all services provided by SK Kosmetik. The services offered by www.sk-kosmetik.com are limited to the geographical area of Switzerland. By placing an order, the customer expressly agrees to these General Terms and Conditions, which apply to all services of the online shop (www.sk-komsetik.com) of SK Kosmetik. SK Kosmetik may amend the GTC applicable to www.sk-kosmetik.com at any time. Such changes come into force immediately upon their publication.
2. products and offers
The complete offer on www.sk-kosmetik.com is non-binding. SK Kosmetik endeavours to provide correct product descriptions, although these may differ from the manufacturer's description. SK Kosmetik accepts no liability for the accuracy, completeness and up-to-dateness of these descriptions. In any case, the customer is requested to take note of the specific product information on the product packaging before use. The product images and illustrations on www.sk-kosmetik.com may differ from the original.
3. prices
The product prices indicated on www.sk-komsetik.com at the time of the customer's order are binding. Should there have been an error in the price information, SK Kosmetik reserves the right to make price adjustments retrospectively. In this case, the customer shall be informed of this circumstance and may cancel the purchase within the period set by SK Kosmetik.
4. Registration
Registration at www.sk-kosmetik.com is reserved exclusively for persons with full legal capacity. By placing an order, the customer guarantees that he/she is at least 18 years old, not incapacitated and capable of judgement. There is no entitlement to admission to the online shop. The data required for registration must be provided by the customer completely and truthfully. The customer himself is responsible for updating his data.
5. order / conclusion of contract
The customer's order is only binding once it has been confirmed by SK Kosmetik by e-mail. SK Kosmetik is free not to confirm an order without giving reasons. With his order, the customer confirms the accuracy of all the information he has provided. SK Kosmetik may withdraw from the contract if the customer's details are incorrect or incomplete. SK Kosmetik shall also be entitled to the right of cancellation if the products are not available from the manufacturer. In this case, SK Kosmetik shall endeavour to find a replacement solution after consultation with the customer. If the customer has no such need, there are no further rights and obligations of the two contracting parties.
6. Payment methods
Customers can pay by PayPal, credit card (MasterCard, Visa card), advance payment, SOFORT bank transfer or by invoice. In all cases, the payment process is carried out using secure SSL encryption technology.
7. Retention of title; offsetting; right of retention
In the case of consumers, we reserve title to the purchased item until the invoice amount has been paid in full. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or recognised by us. Furthermore, you only have a right of retention if and insofar as your counterclaim is based on the same contractual relationship.
If the customer is in arrears with any payment obligations to us, all existing claims shall become due immediately.
9. limitation of quantity
SK Kosmetik reserves the right in any case to limit the delivery quantities for certain products.
10. right of return / right of cancellation
We grant you the right to return products purchased from us. Please return the goods to us in mint condition within 14 days of receipt in the original packaging. The time of dispatch of the goods is decisive for compliance with the deadline.
11. Warranty
The warranty conditions of the product suppliers apply. These are enclosed with the products. SK Kosmetik does not assume any further warranty. In any case, the customer is obliged to contact SK Kosmetik to clarify the type of warranty processing. It is exclusively the supplier's choice which warranty services are provided in the event of a warranty claim. Only the customer is entitled to warranty services and these cannot be transferred. Damage resulting from improper handling, natural wear and tear or external influences for which the seller is not responsible is the responsibility of the customer and does not constitute a warranty claim.
12. Notification period
Defects must be reported in writing within 5 days of receipt of the goods. Otherwise the goods shall be deemed to be faultless and accepted by the customer.
13. transport damage
Transport damage must be reported in writing to both Swiss Post and SK Kosmetik within 5 days. The risk of transport damage shall be borne by the customer, unless he can pass this on to the carrier.
14. Data protection
The data required for business transactions shall be stored, treated confidentially and - with the exception of the case regulated in Section 7 above - not passed on to third parties. Data may be passed on to partners as part of the ordering and delivery process. All personal data will be treated as strictly confidential.
15. Liability
SK Kosmetik excludes, to the extent permitted by law, any liability to the customer for damages and consequential damages (e.g. as a result of accidents and/or injuries suffered for the products sold by SK Kosmetik). Under no circumstances shall breach of contract, impossibility of performance, culpa in contrahendo or tort constitute grounds for claims for damages or a right to withdraw from the contract.
16. Applicable law/jurisdiction
The contract shall be governed exclusively by the Swiss Code of Obligations and other standards issued by Swiss legislation.
The place of jurisdiction for all disputes with SK Kosmetik is Switzerland, subject to deviating mandatory jurisdictions under Swiss federal law.
